Terms & Licensing
The short version. You send photos you have the right to use. We use generative AI to turn them into a tour or images, and every deliverable is marked AI-generated. AI can show things that are not in your photos or in the property — so a tour is an illustration, not an accurate picture of the home. You review everything before you publish it, and you are responsible for how you use it. One revision is free.
These terms apply to every request you submit and every order you pay for. By submitting a request or completing a payment, you agree to them.
1. What the service is
We produce AI-generated property tours, clips and images, using still photographs that you supply as a starting point. The finished deliverable is a marketing visualization. It is not a video recording of the property, a measured survey, a floor plan, an inspection, an appraisal, or an interactive virtual tour.
Four services are offered. Standard prices, with current launch pricing in brackets:
- Reimaging — $150 per room (launch: $75), 6 image limit. Virtually furnishing and styling empty rooms.
- Room to Room — $400 per property (launch: $200), 10 photo limit. A separate clip for each space.
- Captivating Walkthrough — $500 per property (launch: $250), 10 photo limit. One continuous walkthrough.
- Full Home Tour — $800 per property, 20 photo limit, must include hallways and the stairway. Not currently available for purchase.
Launch pricing is a 50% introductory discount on the tour tiers while the studio builds its portfolio. It applies to the tiers only — add-on packages are charged at full price — and it may be withdrawn at any time. The price shown at checkout is the price you pay.
Add-on packages — vertical 9:16 cut ($20), music ($10), logo removal ($50) and 24-hour rush ($100) — may be added to any service.
2. AI generation and accuracy
Every deliverable is created with generative AI. Your photographs guide the result, but they do not control it. The AI creates new imagery, including everything between and beyond what your photographs show.
What that means in practice
A deliverable can show things that differ from the real property, including things that do not appear in any photograph you supplied. For example, it may add, remove, change, distort or invent:
- furniture, decor, fixtures, appliances and finishes;
- materials, colours, lighting, reflections and window views;
- landscaping, outdoor areas and neighbouring structures;
- room sizes, proportions and ceiling heights;
- the layout of rooms and how spaces connect, including rooms, hallways, stairs or areas your photographs do not show.
Details may also be left out, blurred, or shown inconsistently from one moment of a tour to the next. We make reasonable efforts to keep deliverables in keeping with your photographs, but we do not promise that any deliverable accurately or completely represents the property, and it must not be treated as a factual depiction of it.
Reimaging
Reimaging is intended to add virtual furniture and styling that are not in the property. Those additions are deliberate, and they are illustrative only.
The AI-generated label
Every deliverable carries a visible AI-generated label. You must not remove, cover, crop out or obscure it, including when you edit, crop or re-cut a deliverable. The logo-removal package removes the Picture It Tour wordmark only; the AI-generated label always stays. If your MLS, brokerage or state board requires particular disclosure wording or placement, tell us and we will add it.
3. Your review before publishing
You must watch or view every deliverable in full before you publish or share it. You know the property; we work only from the photographs.
- If a deliverable shows anything that could mislead a buyer, renter or guest about the property, do not publish it. Tell us, and we will revise it under section 9.
- You decide whether, where and how to publish, and you are responsible for making sure that what you publish — together with your own disclosures — is not false or misleading.
- Wherever you publish a deliverable, place a clear disclosure next to it. We suggest: “This tour is an AI-generated visualization created from listing photos. It may not accurately show the property, its features, condition or layout.”
- You are responsible for complying with your MLS rules, real estate and short-term rental advertising rules, consumer protection law, fair housing law and platform policies wherever you publish. We can supply disclosure wording, but we cannot give legal advice.
4. Your rights in the finished deliverable
On receipt of payment in full, you are granted a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, display, distribute and adapt the delivered files for marketing the property they were created for, subject to sections 2 and 3. That includes:
- MLS and listing syndication
- Your website, your brokerage's website, and third-party portals
- Short-term rental listings, including Airbnb and Vrbo
- Organic and paid social media, including cuts you make yourself
- Email campaigns, print materials and open-house display
There is no expiry date, no per-platform fee, and no cap on views.
5. Our rights
We retain copyright in the deliverable itself and the right to display it as a work sample — in a portfolio, on this website, on social media, and in proposals to other prospective clients. If you would rather a particular property was not shown publicly, tell us before delivery and it will be excluded. There is no charge for that.
6. Your photographs
By submitting photographs, or a link to a listing, you confirm that you own the photographs or hold a licence permitting their use in AI-generated derivative marketing material, and that you have any permission required from the property owner. Listing photography is very often licensed to the agent rather than owned outright, so it is worth checking your photographer's agreement before sending a gallery.
You keep all rights in your original photographs. We use them only to produce your deliverables and retain them for ninety days afterwards in case you request a revision, after which they are deleted.
7. Photo limits
Each service has a photo limit, listed in section 1. The limit is what drives the work involved, so it is a real constraint rather than an upsell. If you send more than the limit we will tell you which images we would keep, and you can either confirm that selection or move up a tier.
The Full Home Tour requires photographs of hallways and the stairway. The more of the property your photographs cover, the less the AI has to fill in on its own — though, as section 2 explains, it can still show things that differ from the property.
8. Payment and discounts
- Payment is due before work starts unless agreed otherwise in writing.
- Payment is taken on our website through Stripe’s secure checkout, together with any add-ons you choose. We never receive or store your full card details.
- Quotes are firm for fourteen days from issue.
- Three-property discount: book any three tours together and the combined total of the tour tiers is reduced by 15%. The tiers may differ. Add-on packages are charged at full price and do not count toward the discount. This does not stack with launch pricing — while the 50% launch discount is running, that applies instead.
9. Revisions
One revision is included free with every order. Each additional revision is $50.
After payment, your order code is shown on screen and sent to the email address you used at checkout. To request a revision, use the revision form on our website with that order code and the same email address. A revision means one consolidated set of notes — for example pacing, room order, music, shots to cut, or anything that misrepresents the property. The more specific you are, the more likely we are to get it right in one pass.
We keep a record of every revision requested on each order, including how many have been used. Once your free revision has been used, the form asks for the $50 payment before your request is sent, and a paid revision is not received until that payment has gone through. Because deliverables are AI-generated, a revision can reduce but may not completely remove a particular inaccuracy.
Requests that change the scope — adding rooms that were not in the original photo set, switching properties, or moving up a tier — are new work rather than revisions, and are quoted separately.
10. Turnaround
Standard turnaround is three business days from when we have both your payment and a complete photo set. Business days are Monday to Friday, excluding US federal holidays. Weekends and public holidays do not count. Photos received on a Thursday are delivered the following Tuesday.
24-hour rush
The rush add-on ($100) shortens delivery to 24 hours, where capacity allows. The 24 hours start when we have both payment and a complete photo set. If that happens on a weekend or public holiday, the 24 hours start at 9:00 a.m. Pacific Time on the next business day.
If we are late
If a generation run fails or produces unusable output, we will tell you the same day rather than quietly missing the deadline, and we will deliver as soon as we can.
- Rush orders: if we miss the 24-hour deadline, we refund the $100 rush charge. The rest of the order is not refunded, and we still deliver it.
- Standard orders: missing the three-business-day estimate does not entitle you to a refund, but you may cancel as described in section 14.
11. No warranty and no reliance
To the fullest extent permitted by law, deliverables are provided “as is”, without warranties of any kind, express or implied, including any warranty of accuracy, completeness, or fitness for a particular purpose.
A deliverable is not a representation of any property's features, condition, layout, dimensions, square footage, boundaries, views or improvements. It must not be used in place of an in-person viewing, inspection, appraisal, survey, or any disclosure required by law, and you agree not to present it as an accurate depiction of the property.
12. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Picture It Tour against claims, losses, liabilities and costs (including reasonable legal fees) arising from: your publication or use of any deliverable; any failure to review a deliverable or to disclose that it is AI-generated; your breach of these terms; or any claim that the photographs or listing you supplied infringe someone else's rights.
13. Limitation of liability
To the fullest extent permitted by law, our total liability in connection with any project is limited to the amount you paid for that project, and we are not liable for indirect or consequential losses, including lost sales, lost commission, lost bookings or reputational harm.
14. Cancellation
You may cancel at any time. Before production begins, payment is refunded in full. Once production has begun, the amount paid is retained and nothing further is owed.
